Welcome to Clyvii, a mobile application designed for couples who want to share special moments. By using our application, you agree to comply with these Terms of Service. If you do not agree with them, please do not use the application.

2. Service Description

Clyvii offers couples a platform to upload photos, chat with each other, create time capsules, and access a list of predefined dates, as well as create their own personalized dates. The app is available on Android and iOS devices.

3. User Registration

To use Clyvii, it is necessary to register by providing a valid email address. Users must ensure that all information provided is true, accurate, and up-to-date. Each user is responsible for maintaining the confidentiality of their account.

4. App Usage

Use of Clyvii is permitted exclusively for personal and non-commercial purposes. Users agree not to use the app for illegal or unauthorized activities. Clyvii grants a non-exclusive, non-transferable, and revocable license to use the app in accordance with these Terms.

5. Intellectual Property Rights

All content, design, logos, and graphics within Clyvii are the exclusive property of the company or its licensors. Users may not copy, modify, distribute, reproduce, or sell any of the elements of the app without express authorization.

6. User Responsibilities

When using Clyvii, users commit to:

• Not using the app for illicit or harmful activities.
• Not attempting to gain unauthorized access to our systems.
• Keeping their account and password secure.
• Respecting the privacy and rights of other users.

7. Prohibitions

It is prohibited to perform the following actions on Clyvii:

• Abusive use of the service that negatively affects the experience of other users.
• Sharing inappropriate, offensive, or illegal content.
• Manipulating, hacking, or interfering with the operation of the app.

8. Payments and Subscriptions

Clyvii offers premium features through subscription via "Clyvii Premium".

Available Plans:

• Monthly Plan: $4.99 USD/month (billed monthly).
• Annual Plan: $49.99 USD/year (billed annually).

Clyvii Premium Benefits:

• Unlimited unlocked dates (no limit of 3 active).
• Full catalog of emotions to express how you feel.
• More photos in your memories (upload up to 5 photos vs 2 in free version).
• Ad-free experience.
• Support for continuous development of new features.

Free Trial and Renewal:
Clyvii may offer a 7-day free trial for new subscribers. At the end of the trial period, the price of the selected subscription will be automatically charged unless canceled at least 24 hours before the end of the trial period. The subscription will automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the renewal date.

Management and Cancellation:
Payments are processed exclusively through app stores (Apple App Store and Google Play Store). You can manage and cancel your subscription at any time from your account settings in the corresponding store (Apple ID or Google Play). All transactions, refunds, and cancellations are subject to the terms and conditions of the app store. Clyvii does not process payments directly or store user financial information.

9. Liability Limitation

Clyvii does not guarantee that the application is free of errors or that it works uninterruptedly. We are not responsible for data loss, failures in the app's functionality, or any indirect, special, or incidental damages.

10. Modification of Terms

We reserve the right to modify these Terms of Service at any time. If we make changes, we will notify users via the app or email. It is the user's responsibility to review these terms periodically.

11. End User License Agreement (EULA)

The use of Clyvii is subject to Apple's standard EULA (End User License Agreement). By downloading and using our application from the Apple App Store, you agree to the terms set forth in Apple's End User License Agreement.

12. Dispute Resolution

Any dispute related to these Terms will be resolved through binding arbitration in Albuquerque, NM, except that parties may seek injunctive relief in court.
